Terms and Conditions

I. Booking & Payment
- A non-refundable retainer of 30% of the total session fee is required to secure your session date.
- The remaining balance is due in full before the session begins.
- No galleries will be delivered until payment has been received in full.
- Payments are accepted via Cash app, Venmo, or through the Pixieset platform powered by Stripe.
II. Cancellation & Rescheduling
- The retainer is non-refundable but may be applied to a rescheduled date if the client provides at least [5] days' notice.
- Rescheduling is subject to photographer availability and limited to one reschedule per booking.
- Cancellations made less than 12 hours before the scheduled session forfeit the retainer and 50% of any additional payments made, as a reasonable estimate of the photographer's lost booking opportunity; any remaining balance will be refunded within 14 days.
III. Late Arrivals
- Clients arriving late will have their session time reduced accordingly; the session fee is not reduced.
- If the client is more than 10 minutes late without prior notice to the photographer, the session may be canceled and treated as a same-day cancellation under Section II.
IV. Delivery of Images
- Final edited images will be delivered within 3 weeks of the session unless otherwise specified by the photographer in writing.
- Wedding galleries will be delivered in more than 4 weeks but no later than 2 months after the wedding date.
- Images are delivered via Pixieset or another gallery platform of the photographer's choosing.
- Unedited or RAW images are not provided under any circumstance.
V. Editing Style
- By booking, the client acknowledges the photographer's portfolio and agrees that final images will reflect the photographer's artistic and editing style.
VI. Usage & Copyright
- The photographer retains full copyright ownership of all images under U.S. copyright law.
- The client is granted a limited, non-exclusive, non-transferable license to use delivered images for personal, non-commercial purposes, including printing, personal social media posting, and sharing with family and friends.
- Commercial, editorial, or resale use of any image requires the photographer's prior written permission and may involve an additional licensing fee.
- The client may not alter, crop with distortion, or apply third-party filters that materially change an image before public posting without the photographer's consent.
VII. Model Release
- The client grants the photographer permission to use session images for the photographer's portfolio, website, social media, and marketing purposes, unless the client opts out in writing before the session.
- Where any subject of the session is a minor, the parent or legal guardian booking the session represents that they have the authority to consent to this release on the minor's behalf.
VIII. Client Responsibilities
- The client is responsible for arriving prepared and on time, and for the conduct of any minors or guests present at the session.
- The photographer is not responsible for missed shots caused by late arrival, uncooperative subjects, or weather conditions during outdoor sessions.
IX. Weather Policy
- Outdoor sessions may be rescheduled due to unsafe or unfavorable weather at the photographer's discretion, at no additional cost to the client, subject to the rescheduling terms in Section II.
X. Force Majeure
- Neither party is liable for delay or failure to perform caused by events beyond their reasonable control, including weather, natural disaster, illness, injury, family emergency, or other circumstances outside the affected party's control. The parties will work in good faith to reschedule the session as soon as reasonably possible.
XI. Liability
- Except as set out below, the photographer is not liable for injury during the session, or for lost or damaged personal property, except to the extent caused by the photographer's gross negligence or willful misconduct.
- Nothing in these Terms limits liability for gross negligence or willful misconduct to the extent such limitation is not permitted under applicable law.
- In the event of equipment failure or other unforeseen circumstances preventing delivery of images, the photographer's total liability is limited to a full refund of payments made for that session.
XII. Image Storage
- Final images are stored by the photographer for 30 days after delivery. The photographer is not liable for images deleted after this 30-day window.
- It is the client's sole responsibility to download and back up all delivered images within the 30-day window.
XIII. Print & Product Orders
- The photographer is not responsible for print or product quality issues arising from third-party labs or vendors.
XIV. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.
- Any dispute arising from these Terms or a photography session will first be addressed through good-faith direct discussion.
- If unresolved within 30 days, the parties agree to attempt to resolve the dispute through mediation with a mutually agreed mediator before pursuing litigation, with each party bearing its own costs and splitting the mediator's fee equally.
- If mediation does not resolve the dispute within 45 days of a mediation request, either party may pursue the matter exclusively in the courts located in Benton County, Arkansas.
XV. Severability
- If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
XVI. Entire Agreement & Updates
- These Terms, together with any signed booking contract or invoice, represent the entire agreement between the client and the photographer for the session.
- The version of these Terms in effect at the time of booking governs that booking. Updates to these Terms apply only to bookings made after the “Last updated” date shown above.
XVII. Agreement
- These Terms & Conditions will be provided to you via link at the time of booking.
- It is your responsibility to review them; proceeding with your session constitutes agreement to these Terms & Conditions in their entirety.
